A federal law enacted in November 2025 changes the legal definition of hemp, and starting November 12, 2026, viable cannabis seeds capable of producing plants above the new THC threshold will no longer qualify as hemp under federal law. That could make interstate sales and shipping of many traditional high-THC marijuana seeds illegal, which is why seed companies are warning that some products may disappear from the U.S. market or become much harder to buy.
So, as of September 11, 2026, they haven't all been taken off the market yet. The major change is scheduled for November 12, 2026, and state laws can still differ. Low-THC hemp seeds aren't automatically affected in the same way.
